Marc D. Portlock

Mr. Portlock practices in the firm’s insurance coverage and commercial litigation practice groups. He has experience litigating complex coverage disputes in state and federal courts across the country involving mass torts, environmental property damage and construction defect claims. Mr. Portlock also provides insurers with analysis regarding coverage issues prior to litigation, in the form of written opinion letters; potential exposure of insurers under primary and excess insurance policies; the formation of cost-sharing arrangements among insurers; and the potential costs involved in reaching settlement of coverage disputes.

Mr. Portlock’s commercial litigation practice includes representing insurers, employers, and ERISA-governed employee benefits plans in disputes involving bad faith, long-term disability benefits, and subrogation of benefit claims; and defending manufacturers, distributors and contractors involved in mass tort product liability lawsuits. Mr. Portlock’s commercial litigation experience includes deposing numerous party and fact witnesses, successfully arguing summary judgment motions to dismiss negligence and strict product liability claims, recovering medical benefits from third parties, and negotiating the settlement of commercial and tort-based disputes.
